What spec work is
As part of pursuing new projects, Prolific Digital LLC (“Prolific Digital”) often invests significant time and craft into speculative work—deliverables created to illustrate our thinking before any agreement is signed. This includes, but is not limited to, wireframes, interactive prototypes, concept designs, page layouts, draft copy, and related strategy or creative materials prepared for proposals and pitches. We share this work to demonstrate what a partnership with us could look like.
Ownership
All spec work remains the exclusive property and intellectual property of Prolific Digital. Sharing spec work with a prospective client does not transfer any ownership, copyright, or license. Prolific Digital retains all rights in the work unless and until a license is expressly granted or purchased as described below.
License on engagement
When you engage Prolific Digital for a project, the rights you need to the relevant deliverables are released to you as part of the executed agreement or statement of work. In other words, the spec work created for your proposal becomes yours to use under the terms of that agreement once the engagement is in place.
If you don’t select Prolific
If you choose not to move forward with Prolific Digital, the spec work we prepared for you remains ours. You’re welcome to license it: if you’d like to use any of the wireframes, prototypes, designs, or other materials we created, contact us and we’ll arrange a license. We handle licensing on a case-by-case basis—reach out and we’ll walk you through it.
Restrictions
Until a license is granted through an engagement or purchased separately, recipients of spec work may not implement, reproduce, distribute, modify, or publish it, and may not have a third party build from, copy, or recreate it. Spec work is shared to inform your decision, not as a deliverable to be used or handed to another vendor.
